- National Association Of Consumer Advocates Names Mill Valley Lawyer Consumer Attorney Of The Year
[Washington, D.C] — [November 11, 2013] – The National Association of Consumer Advocates is pleased to announce that Mark A. Chavez of Mill Valley, CA received the Consumer Attorney of the Year Award at our Annual Consumer Advocacy Awards Ceremony. The awards were presented at our Annual Membership meeting, which took place on Friday, November 8th 2013 in Crystal City, Virginia.
Chavez was honored for his outstanding work on behalf of consumers throughout his career. He is a partner in the law firm of Chavez & Gertler LLP, of Mill Valley, Calif., which he co-founded in 1994. The firm’s attorneys represent plaintiffs in consumer, employment and civil rights class actions.

- Chavez & Gertler Brings Novel Lawsuit Against Ross Stores and USM For Failing to Pay Wages to Janitors
Chavez & Gertler is part of a team of lawyers representing janitors in a proposed class action against retail giant Ross Stores, Inc. (“Ross”) and leading janitorial contractor USM, Inc. (“USM”) to challenge rampant wage theft from janitors at Ross stores in California. They allege that Ross contracts with USM to clean Ross Dress for Less and dd’s DISCOUNTS stores in California at impossibly low cost. USM, in turn, subcontracts the work to small, fly-by-night subcontractors without providing enough money for the subcontractors to comply with wage and hour and other laws. As a result, the subcontractors routinely fail to pay the janitors who clean the stores the wages they are owed. The workers are represented by Chavez & Gertler, Goldstein, Borgen, Dardarian & Ho, Legal Aid of Marin and the Stanford Community Law Clinic.
The lawsuit brings claims under California Labor Code section 2810, which makes it illegal to subcontract janitorial and other services without providing sufficient funding to allow the subcontractor to comply with all applicable laws.
