Unlawful Collection by Automobile Lenders

Chavez & Gertler attorneys represent care and truck owners whose vehicles have been repossessed and who have been improperly assessed deficiency balances after the sale of their vehicle in violation of the Rees-Levering Automobile Sales Finance Act.  That Act requires that lenders strictly comply with several requirements in providing vehicle owners notice of the lender's intent to sell the vehicle and the borrower's rights to reinstate the loan or redeem the vehicle.  Failure to comply renders any subsequent attempts to collect a deficiency balance void.

Overtime Pay for Employees Working in the Technology Field

Chavez & Gertler represents technology workers who have allegedly been wrongfully denied overtime compensation. Under the Fair Labor Standards Act ("FLSA") and various state laws only a narrow subset and small minority of technology workers (who make over $100,000 per year and are involved in software development or other independent creative work, such as coding or architecture design) are exempt from overtime regulations and may not be entitled to overtime. But the vast majority of technology workers, regardless of how they are labeled or paid (e.g., by salary or hourly) are entitled under state and federal law to overtime pay.
