Judge Certifies GNC Class Action
Alameda County Superior Court Judge George C. Hernandez, Jr. certified a class of GNC store managers and senior store managers on October 23, 2014. As part of the Court’s class action order, Chavez & Gertler and its co-counsel were appointed as class counsel. The case challenges GNC’s policies and practices in California as they apply to managers and senior store managers, who allege that GNC failed to provide meal and rest periods, pay for off the clock work, and reimburse expenses. Judge Hernandez found that the case should proceed as a class action even though GNC contends that it maintained written policies that complied with California law.
